Kevin Spacey will be attending a court date next week in Massachusetts as his request to waive his appearance was denied by a judge.
The 59-year-old actor was charged with felony indecent assault and battery for a 2016 incident at a restaurant in Nantucket. He is accused of touching an 18-year-old man in a sexual manner, against the man’s wishes.
Spacey‘s lawyers said that his “presence will amplify the negative publicity already generated in connection with this case.” They also argued in an affidavit that his attendance would “only serve to heighten prejudicial media interest in the case and will increase the risk of contamination of the pool of jurors available for the trial,” according to People.
Spacey plans on entering a not guilty plea.
The mandatory court appearance is on January 7, 2019.
